An Equality Officer found that a sales assistant’s sexual-harassment complaint against a department store was brought outside the time limit and was not well founded; the merits were not decided. The officer also found that the victimisation claim concerning union representation was not well founded. The decision was dated 11 August 2015.
The sales assistant said a colleague made sexual comments and insults, and that the store failed to take reasonable steps to stop the harassment. The officer found no evidence linking the alleged incidents in 2010 to the formal complaint in November 2012. The officer also found that the Christmas-bonus issue arose after the claim was referred and could not be considered.
