Kulasza loses five discrimination and victimisation claims; equal-pay claim withdrawn

Workplace decision ·

Emilia Kulasza’s five remaining race discrimination and victimisation claims against California White Services Ltd failed. Equality Officer Vivian Jackson dated the decision 18 July 2014. Kulasza had withdrawn her equal-pay claim. Kulasza alleged excessive work, racial harassment and discriminatory or retaliatory treatment when her employment ended. The company denied the allegations and said she resigned on 8 March 2010. The officer found Kulasza resigned of her own volition, so her discriminatory and victimisation dismissal claims failed. Her conditions-of-employment claim failed because she did not establish that the workload decision was influenced by her Polish nationality. The officer found that the water-distiller dispute involved rude and intimidating conduct, but was not linked to her nationality, so the harassment claim failed. The related victimisation claim also failed because the incident preceded her discrimination complaint, which she said was the protected act.
