Department store defeats discrimination complaints; 2008 claims were out of time

By Aoife Loughran

Workplace decision ·

The Equality Tribunal found no discrimination by a department store against a sales advisor and no failure to provide reasonable accommodation. Equality Officer Marian Duffy dated the decision 26 November 2013. The advisor alleged bullying and different working conditions, and said the store had failed to provide suitable duties after he sought to return to work. The store denied discrimination and said it had temporarily accommodated him after his return. The officer found the 2008 conditions and harassment complaints were outside the statutory time limit; the merits were not decided. She found temporary measures had been provided when the advisor returned to work in January 2010. Later, reasonable accommodation did not arise because he was not medically fit to return before retirement. The gender and marital-status claims lacked supporting evidence.
