An Equality Officer rejected a staff nurse’s four complaints against a medical clinic, including claims of disability discrimination, harassment, discriminatory dismissal and failure to provide reasonable accommodation. Vivian Jackson dated the decision 5 February 2013.
The worker said the clinic treated him unfairly after he disclosed a hearing impairment and pressured him to resign during a disciplinary process. The clinic said he had not disclosed the condition on his pre-employment questionnaire and failed to provide medical information it requested.
Jackson found that the worker deliberately withheld information on the questionnaire and later did not provide the requested details. The clinic used its disciplinary process because he did not engage with its requests. A manager berated him over a patient-care issue, but the officer found this was not harassment on disability grounds. She also found that he resigned voluntarily and had not established discriminatory dismissal or a failure to provide reasonable accommodation.
