The Equality Tribunal rejected a software engineer’s three complaints of disability discrimination and harassment, including a claim that his employer failed to provide reasonable accommodation. Equality Officer Conor Stokes dated the decision 21 December 2012. The engineer said his disability affected his punctuality and that he needed to start work at 10.30am. He also said he was selected for a performance review because of his disability and denied an annual bonus because he could not work beyond his contracted hours. The respondent said it agreed to change his working hours and that bonuses depended on performance. The officer found the engineer had not established that he needed accommodation to perform his role. The harassment complaint failed because other employees were also reviewed and the officer found it difficult to link his selection to his disability. The bonus complaint failed because he had not established less favourable treatment on disability grounds; three underperforming employees also received no bonus. The officer recommended that the respondent ascertain the extent of the disability notified to it.
