The Equality Tribunal found that Kirwan Aluminium Ltd did not discriminate against Boguslaw Kutek on racial grounds in his employment conditions or through harassment. Equality Officer Marian Duffy’s decision was dated 11 October 2012. Kutek, a Polish national who worked as a general operative, said he was given dirty jobs, called offensive names and whistled at by a co-worker. He also said he was paid less than other workers and was not registered in the construction industry pension scheme. Kirwan Aluminium Ltd said it paid none of its workers the registered employment agreement rate and that employees were treated alike regardless of nationality. The officer found workers were treated equally on pay and pension matters. On the harassment complaint, she preferred the employer’s witnesses’ evidence and found Kutek had not established that he was subjected to a hostile or offensive environment.
