The Equality Officer found against Mr Dariusz Lubianka on his race discrimination complaint after he failed to attend the hearing. The decision was dated 20 June 2012; the merits were not decided. Lubianka alleged that Portella Developments Ltd discriminated against him in training and conditions of employment. The company and Lubianka’s representative attended the hearing, but Lubianka could not be contacted. His representative accepted that the case would fail for want of prosecution. The Equality Officer found Lubianka’s failure to attend unreasonable and concluded the investigation without evidence supporting the allegation.
