An Equality Officer found that a contractor discriminated on racial grounds against two Polish workers and ordered him to introduce procedures to eradicate racist language in his employment within six months, including sanctions for continued use. The decision was dated 17 May 2012.
The workers said the contractor used abusive and discriminatory language during an argument on 11 December 2008. He denied the allegations, while saying he may have used similar language during a dispute after employees damaged rented accommodation. The Equality Officer found that the evidence established facts from which race discrimination could be inferred. The gender discrimination complaints failed because the suggested name-calling did not establish facts from which discrimination on gender grounds could be inferred.
