Equality Tribunal rejects job applicant’s three complaints against employment group

By Ruairí Dolan

Workplace decision ·

The Equality Tribunal rejected a job applicant’s complaints of disability discrimination, failure to provide reasonable accommodation and victimisation against a community employment group. The decision was dated 3 April 2012. The applicant said he was not called to interview for a reception and information support post because of his disability, and that the decision was retaliation for an earlier complaint. The group said his application arrived after the closing date and late applications were not considered. The Equality Officer found the applicant had not shown that his application was submitted on time and accepted that the failure to interview him was unrelated to his disability. The reasonable accommodation complaint failed because he presented no supporting evidence. The victimisation complaint failed because the group did not know his identity when it set aside the late application.
