Equality Tribunal rejects five disability-related claims against security firm

By Eimear Byrne

Workplace decision ·

The Equality Tribunal rejected five claims by a complainant against a private security firm, finding that none established a prima facie case. The decision was dated 8 December 2011. The complainant alleged discriminatory treatment and dismissal, harassment, victimisation and failure to provide reasonable accommodation on disability grounds. The firm said he had not disclosed a learning disability during recruitment and that his conduct at work led to suspension and dismissal. The officer found that the complainant had not shown less favourable treatment in training, provided too little detail to establish harassment, or linked his dismissal to disability. The victimisation claim failed because he did not establish credible facts supporting it. The accommodation claim failed because he did not show that the measures he sought were needed due to his disability.
