Equality Officer rejects grocery store worker’s disability discrimination complaint

By Eimear Byrne

Workplace decision ·

A grocery store worker’s disability discrimination complaint failed after she did not establish a prima facie case, Equality Officer Tara Coogan found in a decision dated 4 May 2010. The employee said managers repeatedly required her to explain her disability and alleged she was humiliated when told to work at a larger checkout. The store denied discrimination and said it proposed a medical assessment to identify workplace assistance she needed. Coogan found no evidence that assigning her to the belted checkout treated her less favourably than a person without a disability. She also found that the store began investigating after receiving a formal complaint and allowed her to use an express checkout pending medical assessment.
