An Equality Officer found that a third-level educational establishment discriminated against Mr X by failing to provide reasonable accommodation during part of his medical examinations, and awarded him €1,000. The decision was dated 19 November 2008.
Mr X said the establishment failed to accommodate his disability in examinations and that he faced harassment while seeking support. The establishment denied discrimination and harassment but acknowledged mistakes in handling his requests. The officer found that the separately administered Data OSCE component in May 2005 was a written examination and that appropriate measures had not been provided. The officer did not find harassment.
The officer also found that Mr X was not an employee of the establishment during his funded internship. The statutory redress limit for the case was €12,697.38; the compensation awarded for the discrimination was €1,000.
