The Labour Court affirmed a €780 compensation award to Olayinka Oladiti after rejecting her appeal to have an earlier period considered. The determination was signed on 28 October 2014.
Oladiti argued that the Rights Commissioner should have considered November 2011 to November 2012. Noel Recruitment Agency Ltd had not appealed the finding of a contravention or the award. The Rights Commissioner considered alleged contraventions from 22 January to 28 April 2013, applying the maximum 12-month extension allowed from the complaint date. The Labour Court said section 25 did not permit consideration of the earlier period, so the €780 award remained in force.
