The Workplace Relations Commission found Ashling Moloney’s Sick Leave Act complaint against the HSE not well founded. She alleged the HSE penalised her after declining to defer two weeks of Shorter Working Year Scheme leave while she was on sick leave. The HSE argued its sick leave scheme provided greater benefits than the Act. Adjudication Officer Gaye Cunningham dated the decision 7 September 2026. The officer said the dispute concerned sick pay during planned scheme leave, rather than an entitlement under the Act.
