The Workplace Relations Commission found a disability discrimination and reasonable accommodation complaint against Graham O’Sullivan Café not well-founded. Adjudication Officer Eileen Campbell’s decision was dated 4 June 2025.

Glenn Byrne’s family alleged that café staff discouraged him from using the counter and made them feel unwelcome. The café denied refusing service; its manager said she offered help and suggested a quieter table and having the carer order.

After considering the parties’ evidence and CCTV, Campbell found no refusal of service or denial of access. She found the café had sought a flexible response while balancing Byrne’s needs with its duty of care, and concluded that discrimination and failure to provide reasonable accommodation were not established.
