WRC rejects Oliveira’s race discrimination complaints over hospital recruitment

The Workplace Relations Commission dismissed Vitor Oliveira’s race discrimination complaints against St Vincent's University Hospital in a decision dated 20 June 2025. Oliveira alleged he was indirectly discriminated against after he was not shortlisted for a Senior Finance Manager role requiring an ACA, ACCA or CIMA qualification.

The hospital said Oliveira had not shown that his qualification was equivalent to the specified credentials. The adjudication officer found that Oliveira had established a prima facie case of indirect discrimination, but accepted that the qualification requirement was necessary and appropriate for the senior role. The Employment Equality Act complaint was not well founded; the Equal Status Act complaint was dismissed because it concerned employment rather than a service.
