The Workplace Relations Commission found Thomas Delaney was unfairly dismissed by Nsp Expert Lab Solutions and awarded him €10,000 in compensation for loss of earnings. The decision was dated 26 June 2025.
The employer said it summarily dismissed Delaney over a recorded conversation it considered gross misconduct. Delaney said he was not given the transcript or a chance to answer the allegations before the dismissal decision. The adjudication officer found no allegations had been put to him and he had no opportunity to respond or make representations.
Delaney said he had been unemployed for 14 weeks after losing his job and earned €1,085 gross a week. The adjudicator awarded €10,000 for loss of earnings, noting he had not provided evidence of efforts to find alternative work.
