The Workplace Relations Commission awarded Michelle Murray €5,580 compensation after finding that her dismissal by Cagney Contract Cleaning t/a Cagney Maintenance Service Ltd was procedurally unfair. In a decision dated 16 June 2025, it also awarded her €4,500 because the employer had not provided a written statement of employment terms.
The WRC found the employer had reasonable grounds for dismissal, including workplace conduct and issues with training records, and that the dismissal was substantively fair. But Murray could not directly challenge reports relied on in the disciplinary process. The WRC said her substantial contribution to the dismissal and mitigation of loss informed the compensation award.
The WRC rejected complaints about Employment Regulation Order breaks, notice of changed terms and carer’s leave; Murray withdrew separate equality and employment-terms complaints. It also rejected another carer’s leave complaint, finding no formal application had been submitted and no leave had been refused.
