The Workplace Relations Commission awarded Piotr Zientara €10,000 after finding his dismissal by Apicem Projects Limited trading as Apicem was unfair. The decision, dated 11 June 2025, also awarded €2,167.50 for underpaid notice and €2,167.50 compensation for not receiving written employment terms.
The adjudication officer accepted the business faced genuine operating difficulties but found it did not consult Zientara, consider alternatives or explain why he was selected instead of another general operative. The officer found his service had transferred between businesses, giving him more than five years’ service and entitlement to additional notice. His redundancy-payment complaint was not well founded; his complaints about unfair dismissal, notice and employment terms were upheld.
