The WRC found an employee’s Payment of Wages Act complaint against a policing service not well founded in a decision dated 24 October 2024. She said delays issuing a Code 11.37 certificate led to lost pay and sought restoration of pay and sick days.

The policing service said the employee had received her sick-leave entitlements and had no automatic entitlement to the certificate. It also said it offered €57,612.94 to restore full pay for a period affected by an unrequested transfer, but the employee did not accept the offer.

The adjudication officer said her authority under the Payment of Wages Act did not extend to deciding whether the employee’s absence should be classified as an injury on duty under Code 11.37. The complaint was found not well founded.
