Legs Eleven Limited, which runs the Bingo Loco stage show, was ordered to pay former employee Gareth Elliot €5,400 after the Workplace Relations Commission (WRC) found his dismissal unfair. The WRC decision was dated 28 August 2024. The award is equivalent to eight weeks’ gross pay and is subject to statutory deductions.
Elliot’s content marketing manager role was made redundant after a downturn in ticket sales. He argued that he could have moved into a social media marketing role and said others continued some of his work. The company said he did not have the experience it sought for that position.
The adjudicator accepted that a genuine redundancy existed, but found the company should have considered redeploying Elliot and let him try the social media role before deciding to dismiss him. The process also gave him little time after he was told his job was at risk, and he was not told about a right to representation or appeal. The WRC chose compensation because Elliot had started a new job. He had also received a separate €3,240 statutory redundancy payment.
