The Workplace Relations Commission ordered Castlegale Electrical Ltd to pay labourer Michael McGuire €6,013 after finding it failed to provide construction sector minimum pay rates. Adjudication officer Gaye Cunningham also awarded €1,200 for failure to provide written employment terms and €2,000 over sick pay and pension provisions.

The decision, dated 26 June 2024, followed complaints about McGuire’s pay and entitlements during employment from May to December 2023. He said he was paid €10 an hour and had not received written terms. The employer said the job was intended to be temporary, work was drying up, and McGuire had received sick pay and holidays.

The WRC found complaints under the National Minimum Wage Act and Payment of Wages Act not well founded, and also rejected claims under road transport and fixed-term work rules. A further complaint about a written statement of core terms was well founded, but attracted nil compensation because the written-terms breach had already been compensated.
