The Workplace Relations Commission awarded Brian Cunningham €10,000 after finding Limerick Island Community Partners had unfairly dismissed him. In a decision dated 6 June 2025, the WRC found the organisation had not established a clear retirement age for his role or other grounds justifying his dismissal.
Cunningham had worked as an estate management worker for about 25 years. The respondent said its retirement age was 65 and relied on an unsigned 2013 contract; Cunningham said he had not received it and relied on his earlier signed terms. The WRC found insufficient evidence that 65 was the normal retirement age for employees in similar work.
The WRC rejected Cunningham’s separate minimum-notice complaint, finding that written notice given on 8 March 2023 exceeded the statutory requirement. The respondent denied both complaints.
