The Workplace Relations Commission awarded Nina Gorelova-Charskaia €5,850 after finding that she was unfairly dismissed by way of constructive dismissal by Waterford English Language Centres Ltd. It also awarded her €975 for the employer’s failure to provide written terms of employment. The decision was dated 29 August 2024.
Gorelova-Charskaia said her hours were reduced after she told the school she was pregnant and that her employer’s conduct led her to resign. The school said a temporary reduction affected three staff during a business downturn and was not connected to her pregnancy. The adjudicator found that the school had not discriminated against her, noting that other staff had their hours reduced and her full hours were restored after she objected. One other written-terms complaint and a working-time complaint were withdrawn at the hearing.
