The Workplace Relations Commission found Tracy Watson’s service with Treasure Chest Limited Cro was continuous from 31 May 2004 to 21 October 2022 and ruled that her redundancy complaint was well founded. The decision was dated 5 June 2024.
Watson sought statutory redundancy pay after the shop ceased trading in September 2023. She said she had not resigned in May 2021 and believed she remained employed while on sick leave. The company argued that she left in May 2021 and returned as a new employee, and also said the claim was out of time if her employment ended in October 2022.
The WRC found the evidence supporting an alleged 2021 resignation unreliable and found the complaint was within the statutory time limit, even using the company’s asserted October 2022 end date. It ordered the company to pay Watson her statutory redundancy entitlements.
