The Workplace Relations Commission rejected three complaints by Pieter Joubert against Post Formed Systems Ltd, finding that his allegations of penalisation, unfair dismissal and health and safety penalisation were not well founded. Adjudication Officer Lefre de Burgh issued the decision dated 27 August 2025. No award was recorded.
Joubert said he was dismissed in retaliation after reporting an incident in which a new employee was told to clean a canteen floor with paint thinners and after raising grievances. The company denied the claims, saying the email did not amount to a protected disclosure and the dismissal followed trust concerns.
The officer found the email did not disclose relevant information or establish a health and safety complaint, and found no link between it and the dismissal. The officer accepted the company’s evidence about failures to follow instructions and access to information, finding that these caused a breakdown in trust. The unfair dismissal complaint was also rejected because Joubert lacked the required service.
