The Workplace Relations Commission found that Thomas Kasak was unfairly dismissed by Munster Derivatives and awarded him €460 in compensation. The decision was dated 25 October 2024.
Kasak worked as a delivery driver and earned €460 gross a week. The company attributed his dismissal to driving, delivery and conduct incidents, including an incomplete route in September 2023. Kasak denied several allegations and said he was dismissed without warning or notice.
The adjudication officer found the dismissal procedurally unfair because the company did not follow fair procedures, give Kasak a proper opportunity to answer the allegations or offer an appeal. The officer accepted the director’s evidence as more credible on the disputed incidents and found that Kasak contributed in no small measure to his dismissal. The €460 award was compensation for loss of remuneration.
