The Workplace Relations Commission found a complaint by Georgina Coyne against Joyces Supermarket over the transfer of her employment was not well founded. The decision was dated 19 August 2024. Coyne began working for Joyces Supermarket in 2000, and her employment transferred to the respondent in September 2022. The dispute concerned her work pattern and whether she could keep a manager role. Tesco said it could not fit her previous pattern into its management shifts, but offered the same hours and substantive terms in a different role. Coyne said that role did not include her previous direct responsibility for managing staff. She resigned in May 2023. The adjudication officer found that her terms and conditions had transferred to the new employer and that the proposed change arose from an organisational need. The complaint against Joyces Supermarket, as transferor, was not well founded; no breach relating to the transfer of terms was found.
