The Workplace Relations Commission found that Musgrave Operating Partners Ireland’s sick pay scheme was more favourable overall than statutory sick leave, and found Karolina Leszczynska’s complaint not well founded. Leszczynska, a shop assistant at the company’s Tyrrellstown store, said she received pay for only one day of a four-day illness absence in January 2023. The Commission decision was dated 25 September 2023. The company’s scheme provided up to eight weeks of full pay, less social welfare benefit, after three unpaid waiting days and six months’ service. The adjudication officer found that its longer payment period and higher rate outweighed the waiting period and service requirement.
