The Workplace Relations Commission found Lina Leliugiene’s complaint over wage deductions not well founded in a decision dated 3 July 2023. The adjudicator found Derry Court Cleaning Specialist was entitled under the Payment of Wages Act to recover wages it had overpaid, even without Leliugiene’s permission. Leliugiene said her pay rose after her employment transferred to the company under TUPE, but the employer later treated the increase as an error and deducted the overpayment from her wages. The company accepted making deductions without her consent and argued it could recover the overpaid wages. The adjudicator found that Leliugiene acknowledged she had been overpaid.
