WRC finds civil servant’s complaints withdrawn, out of time or unsuccessful

A civil servant’s complaints against a State Department were withdrawn, brought outside time limits or unsuccessful, the Workplace Relations Commission found in a decision dated 13 August 2024. The six complaints included allegations of race discrimination and sexual harassment, a protected disclosure claim and a dispute over an unpaid increment.

The WRC found the disability, sexual harassment, unfair dismissal, age and civil status complaints were brought outside the relevant time limits; the complainant did not seek an extension for the disability or sexual harassment complaints. For the unfair dismissal, age and civil status complaints, the decision said they were statute-barred and not well founded; the merits were not decided. The officer also found, for completeness, that the employee had not provided medical evidence to establish a disability.

The race complaint failed because the officer found the workplace conversations were not directed at or about the employee and did not establish discrimination. The increment complaint failed because she did not provide requested medical evidence to recategorise her sick leave. The officer found she had not made a protected disclosure. A separate complaint was withdrawn. No complaint succeeded.
