The WRC found that a worker’s Payment of Wages Act complaint against a policing service was not well founded. Adjudication Officer Ewa Sobanska dated the decision 22 October 2024.
The worker said delays in issuing a Code 11.37 certificate reduced her pay and sought restoration of pay and sick leave treatment as injury on duty. The service said she had received her sick leave entitlements and was not automatically entitled to the certificate. It also said it had offered €57,612.94 for a period linked to an unrequested transfer, which the worker did not accept.
The officer said her jurisdiction under the Payment of Wages Act did not extend to deciding whether the worker’s illness qualified as an injury on duty under the relevant code. She declared the complaint not well founded.
