WRC rejects Ann Marie Harbourne's constructive dismissal complaint

The Workplace Relations Commission found that Ann Marie Harbourne was not unfairly dismissed, constructively or otherwise. The decision, dated 31 May 2023, concerned her resignation from Smyth Mahon Ltd after she was offered a retail role. Harbourne said she had been left with no alternative but to resign after the business reviewed its post office work. The company said the retail job offered the same hours and pay. The WRC found no dismissal had taken place within the six months before she lodged her complaint, so it was outside the statutory time frame. The merits were not decided.
