The Workplace Relations Commission found that landlord Anna O'Reilly discriminated against tenant Mariana Gabor on the housing assistance ground and ordered €7,000 compensation. The decision was dated 24 May 2023.

Gabor said O'Reilly initially agreed to support her Housing Assistance Payment (HAP) application, then did not complete the required form. O'Reilly said she needed to resolve tax matters and obtain documents required to qualify as a HAP landlord.

The WRC found that O'Reilly had not returned the form for seven months and that Gabor's evidence of discrimination had not been rebutted. HAP is a state rent support scheme. The €7,000 compensation order includes seven months of HAP payments, stated in the decision as €4,165.
