The Workplace Relations Commission awarded Shane Howard €6,798 after finding that he was unfairly dismissed when he resigned from Attitude Technologies Limited. The decision was dated 21 July 2023.

Howard worked as a sales representative. He said the company failed to pay his wages for June, July and August 2022, despite providing payslips and repeated attempts to contact its chief executive. The WRC accepted his evidence that he had not received his full wages and ordered the company to pay him the net sum of €5,269 under the Payment of Wages Act.

The officer found that the non-payment made it reasonable for Howard to end his employment, and upheld his constructive-dismissal complaint. Howard found a new job at a higher salary about three months later. The €6,798 award represented three months’ net pay for his financial loss.
