The Workplace Relations Commission found Grace Broderick’s complaint that Tesco Ireland unlawfully withheld sick pay was not well founded in a decision dated 28 June 2023. Broderick had worked for Tesco for about 20 years and was a line manager in Dundalk. Tesco told her she would be moved to Balbriggan, a 45-minute drive away, with six days’ notice. The adjudicator found the move was communicated without explanation or consultation. Broderick went on work-related stress leave and later resigned rather than move. The adjudicator said Broderick had no automatic right to sick pay under Tesco’s discretionary scheme, so the refusal was not an unlawful deduction from wages. The complaint concerned sick pay; the decision did not find the transfer was lawful or fair.
