The Workplace Relations Commission awarded Áine Fitzhenry €250 compensation after finding that her former employer failed to give her a written statement of her new managerial terms. The decision, dated 24 July 2023, said the breach followed her promotion and was technical. Fitzhenry, a crèche manager, also complained of constructive dismissal and a failure to pay a loyalty bonus. The WRC rejected both complaints: it found she had not proved constructive dismissal, and that the disputed bonus was not a deduction from wages. Fitzhenry said the bonus was worth €2.25 an hour and alleged a shortfall of about €3,150. The respondent said it had offered her an annual salary of €39,000, which she declined. The €250 was compensation for the statutory breach, not wages.
