WRC recommends €10,000 for psychiatric nurse after unfair interview

The Workplace Relations Commission recommended €10,000 compensation for a psychiatric nurse who was denied a fair and impartial interview and a proper review of his grievance. In a decision dated 23 November 2022, it also recommended €5,000 for unfair treatment in acting appointments.

The worker said he was passed over for acting roles despite his panel ranking and that candidates who did not meet the advertised criteria were appointed. The mental health service provider said acting arrangements were temporary and depended on staff availability. The adjudicator found that the appointments breached recruitment guidelines and policies, and that the provider’s desktop review did not hear the nurse or properly examine his grievance. A third Industrial Relations complaint duplicated the acting appointments complaint and required no separate recommendation.
