The Workplace Relations Commission dismissed Niamh Carroll’s constructive unfair dismissal complaint against Newbridge Merchant Limited, finding she was not unfairly dismissed. The decision was dated 21 June 2023.
Carroll worked as a store manager at the company’s Portlaoise outlet from 2012 until 2021. She said a disciplinary process, a final written warning and a lack of support led her to resign. The company argued she had resigned voluntarily.
The adjudication officer found the company acted reasonably in investigating the store issues and issuing the warning, and that it took steps to reduce pressure on Carroll. The officer also found Carroll acted unreasonably by not using the internal appeal process before resigning. The complaint was dismissed on its merits. Two other complaints were withdrawn.
