The Workplace Relations Commission awarded Jane Stewart-Bird €1,380 after finding she was unfairly dismissed by Petrogas Group Ltd. The decision was dated 23 November 2022.
Stewart-Bird said she was dismissed while on sick leave without warning or notice, and that the company could have used her administrative skills. Petrogas said she was unfit for her role and had no prospect of returning in the foreseeable future.
The adjudicator found the company acted unreasonably by dismissing her without notice, noting that correspondence referred to possible return-to-work discussions and adjustments. Stewart-Bird was unavailable for work and had incurred no financial loss. The decision records €920 compensation plus €460 in lieu of notice, while its formal award describes €1,380 as compensation including two weeks’ minimum notice.
