Revenue Commissioners win pay complaint over sick leave and increment

The Workplace Relations Commission found a complaint by Revenue clerical officer Claire O’Connell not well founded in a decision dated 9 May 2023. She argued that sick leave rules reduced her pay and delayed her salary increment; the Revenue Commissioners said her accumulated sick leave meant she was not entitled to ordinary sick pay. The adjudication officer found that €917.73 in deductions was outside the period the WRC could examine because the weekly recoveries began in June 2022. The officer also found that O’Connell had not shown she was contractually entitled to the €157.36 increment payment she claimed. Pension payments were outside the Act’s definition of wages, so the WRC had no jurisdiction to consider that part of her claim.
