The Workplace Relations Commission found that Brigid Cash was not discriminated against on the Traveller community ground by C.P. Roche & Company Limited t/a Roches Allcare Pharmacy. The decision, dated 24 May 2023, said her case failed because she had not established a prima facie case of discrimination.
Cash said pharmacy employees followed her and her daughter after they left the store and accused her of having been caught on camera, causing distress and embarrassment. The pharmacy said an employee suspected a theft, while staff denied making the alleged public accusation. It said a supervisor apologised after recognising Cash and her daughter as regular customers.
The adjudicator reviewed CCTV footage and found the cashier had not known Cash was a member of the Traveller community. The WRC concluded the treatment was not the result of prohibited conduct under the Equal Status Acts. The decision addressed the Traveller-ground discrimination claim; it does not set out separate outcomes for the other two complaint references.
