The Workplace Relations Commission found that Amanda Toolan’s complaint of penalisation under the Employment Permits Act was unfounded. The decision, dated 14 November 2022, concerned her return to work at Galway Hospital while she worked for Campbell Catering Limited trading as Aramark Food Services.

Toolan said she had raised concerns about possible permit compliance issues, including a recruit’s paperwork, and alleged that the requirement for her to return full time was retaliation. The company denied penalising her and said workplace issues were unrelated to compliance concerns.

The adjudication officer accepted that Toolan had flagged paperwork that was not in order, but said HR confirmed the issue and treated it as routine. The officer found that the on-site requirement arose from business needs, including staffing a 700-bed hospital, and that there was no connection between it and the permit issue. The complaint was found unfounded and Toolan failed.
