Flutter wins WRC case over loss of overtime during Covid restrictions

The Workplace Relations Commission found a complaint by Tammy Lynch against Flutter Entertainment Plc not well founded. Lynch, a deputy manager at the company’s Raheny branch, said she lost regular overtime earnings when betting shops reopened during Covid-19 restrictions and she was rostered for 40 hours a week instead of her usual 48 hours every second week. The WRC decision, dated 11 November 2022, accepted that Lynch’s overtime was regular and rostered but found it was not compulsory or a contractual entitlement. The officer said hours she did not work were not wages properly payable under the Payment of Wages Act 1991, so their loss was not an unlawful deduction. The complaint was not well founded.
