The Workplace Relations Commission found Marie McKenna’s complaint against Flutter Entertainment Plc not well founded in a decision dated 11 November 2022. McKenna, a Mountview shop manager, said her hours were reduced after betting shops reopened during the Covid-19 pandemic, costing her regular overtime earnings. Her contract required 40 hours a week, with overtime paid at time and a half when worked. The adjudicator found that although McKenna’s overtime was regular and rostered, it was not compulsory or guaranteed by her contract. The shops had restricted opening hours and reduced trade after reopening, and she was limited to her contractual 40 hours. The Commission concluded that overtime she did not work was not wages properly payable under the Payment of Wages Act 1991, so its loss was not an unlawful deduction. The complaint was dismissed.
