The Workplace Relations Commission found Victoria Callow’s complaint against Flutter Entertainment Plc not well founded, after she said restrictions on overtime reduced her earnings. The decision was dated 11 November 2022. Callow, a manager at the company’s Raheny store, said she normally worked four shifts one week and five the next, with overtime forming part of her usual hours. Flutter said her contract required 40 hours a week and overtime depended on business needs. After the shops reopened with reduced trading hours during the Covid-19 pandemic, it said there was no need for overtime. The adjudication officer found that Callow’s overtime was regular and rostered, but was not compulsory or required by her contract. The hours she missed were not hours worked, so the lost overtime was not wages properly payable under the Payment of Wages Act. The complaint was dismissed.
