The Workplace Relations Commission allowed Samantha McLoughney’s redundancy complaint against Imelda Cusack, awarding her statutory redundancy subject to confirmation that her employment was insurable. The decision was dated 15 November 2022. McLoughney worked as a beauty and body tutor. She sought redundancy pay after the business ceased operating during the pandemic and she received no formal redundancy notice. Cusack confirmed that the position was redundant but said she could not afford the payment. The WRC found that McLoughney’s employment ended by reason of redundancy on 26 October 2021. Her entitlement is calculated at two weeks’ pay for each year or part-year of reckonable service, plus one additional week, subject to confirmation by the appropriate government agency. Her gross weekly wage was €372.44.
