The WRC found Edward Monaghan was unfairly dismissed and awarded him €1,750. The decision, dated 28 September 2022, followed a dispute over whether his employer, A. McGuinness & Sons Limited, had dismissed him.
Monaghan said he believed he had lost his job after a pay dispute and a Christmas Eve conversation with his employer. The company denied dismissing him and said he did not return to work after Christmas. The Adjudication Officer found Monaghan’s account more credible, and considered the conversations on 24 December and 4 January, along with the employer’s failure to call as promised on 5 January. The Officer found it reasonable for Monaghan to believe he had been dismissed.
The award was made under the Unfair Dismissals Act 1977. The decision does not give a further breakdown of the €1,750 award.
