The Workplace Relations Commission dismissed a veterinary inspector’s complaint that he was penalised for making a protected disclosure, finding the claim frivolous or vexatious. The decision was dated 1 November 2022.

Andrew Conway said his complaint concerned reputational harm and stress arising from a later investigation into his disclosure. The Department Of Agriculture Food and Marine argued that related matters had already been considered by the WRC, Labour Court and High Court.

The adjudicator found the dispute had already been determined, that Conway was repeating and supplementing an earlier complaint, and that the new claim could not succeed. It was dismissed under section 42(1) of the Workplace Relations Act 2015.
