WRC finds Declan Walsh was not unfairly dismissed by First Glass Limited

The Workplace Relations Commission found Declan Walsh was not unfairly dismissed by First Glass Limited, citing substantial grounds for dismissal, a proportionate sanction and fair procedures. The decision, dated 7 November 2022, concerned Walsh’s dismissal in June 2021 after nearly 19 years with the company. First Glass said he exceeded permission while on its premises and gave differing accounts during the investigation. Walsh argued that dismissal was disproportionate given his service and that procedures were improper. The adjudicator found the conduct and lack of cooperation were serious, and the dismissal was proportionate despite Walsh’s long service. The WRC also found the company followed its disciplinary policy, explained the allegations, gave him opportunities to respond and told him he could appeal.
